Planet on the move

Our living planet is and has always been on the move. Many species move in search of necessities such as food, water, shelter, reproduction, and safety. In some cases, movements are an adaptive response to environmental stresses and shocks; in other cases, environmental change, whether land degradation, climate change or other forms, may add to other drivers of migration. This report seeks to assess conservation challenges and opportunities at the confluence of migration, environmental change and conflict; initiate a widely inclusive dialogue with sensitivity towards justice and the difficult trade-offs ahead; and peer cautiously into the future while offering some optimism through the lens of environmental peacebuilding.

Sustainable investing in protected areas and biodiversity

This publication provides initial guidance to countries on key enabling tools for attracting public and private sector investments in conservation and how to navigate the process. It builds on a series of recent ELC protected areas and biodiversity projects, prompted by emerging investor interest in the sustainability of their investments and responding to the growing funding gap between what is needed and what is available in traditional financial sources (grants, philanthropy, national budgets and loans) to effectively address the planet’s growing environmental crises – accelerating biodiversity loss, climate impacts affecting the Earth and society, and expanding land, marine and ecosystem degradation.

Medir la efectividad del derecho ambiental a través de indicadores jurídicos y análisis de calidad

Los esfuerzos para evaluar la efectividad del derecho ambiental mediante indicadores jurídicos son indispensables en un momento en que el  derecho ambiental, su implementación y cumplimiento efectivos son cruciales en la transformación global hacia una sociedad sostenible. El  derecho ambiental requiere herramientas que permitan a los gobiernos y a la sociedad en general medir con precisión e informar sobre la medida en que la ley se está aplicando de manera correcta y efectiva. Los indicadores jurídicos ambientales, con sus correspondientes pasos  metodológicos de cumplimiento, proporcionan esta precisión necesaria para medir la efectividad de la ley. Esta publicación reúne las ideas  jurídicas presentadas durante el segundo Congreso Mundial de Derecho Ambiental (Diciembre de 2021) y muestra el trabajo en curso sobre  indicadores jurídicos ambientales llevado a cabo por la CMDA y sus asociados.

Mesurer l’efficacité du droit de l’environnement à travers des indicateurs juridiques et des analyses de qualité

Les efforts visant à évaluer l’efficacité du droit de l’environnement au moyen d’indicateurs juridiques sont indispensables à un moment où le droit de l’environnement, sa mise en oeuvre et son application efficaces sont essentiels à la transformation mondiale vers une société durable. Le droit de l’environnement nécessite des outils qui permettent aux gouvernements et à la société en général de mesurer avec précision et d’informer sur la mesure dans laquelle le droit est correctement et efficacement appliqué. Les indicateurs juridiques environnementaux, avec leurs étapes méthodologiques de conformité correspondantes, fournissent la précision nécessaire pour mesurer l’efficacité de la Loi. Cette publication rassemble les idées juridiques présentées lors du 2e Congrès mondial du droit de l’environnement (décembre 2021) et met en valeur les travaux en cours sur les indicateurs juridiques environnementaux menés par la CMDE et ses partenaires.

Using the IUCN red list criteria at the national level : a regional consultative workshop for South and Southeast Asia… : proceedings and recommendations

A regional workshop was held to develop a shared understanding of the IUCN global Red List criteria, threat categories and the process of listing species according to the threat of extinction with an emphasis on lessons learned, key constraints and priority needs. The report presents country status reports from Cambodia, India, Indonesia, Lao PDR, Malaysia, Nepal, Pakistan, Philippines, Sri Lanka, Thailand and Vietnam, plus conclusions and recommendations.

The TRIPS agreement, sustainable development and the public interest : discussion paper

This paper addresses the environmental and developmental impacts of patent protection by specifically focusing on the global agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). While the TRIPS agreement serves as an important step in harmonizing international intellectual property systems, the author contends that it currently fails to properly balance public and private interests, especially in the gap between rich and poor. This thoughtful paper can serve as a base from which to debate a serious issue and suggest proposals for reform.
